Upon registration, and in consideration for the opportunity to participate in and profit from the Growing Kids Sale, each consignor will be required to agree to the following Growing Kids Consignor Agreement:
- Seller agrees to hold harmless and make no claim against Growing Kids Consignment Sale, LLC, the Officers of Growing Kids Consignment Sale, LLC, the lessors of the space where the sale is held, any teammates or paid participants in Growing Kids, or the insurer of Growing Kids for the damage, theft or loss (including loss due to fire, flood, building or equipment malfunction or natural disasters) of any items consigned to Growing Kids.
- Seller agrees to waive any and all claims for personal injury resulting from participation in Growing Kids from whatever cause either foreseen or unforeseen against the Growing Kids Consignment Sale LLC, the Officers of Growing Kids Consignment Sale, LLC, the lessors of the space where the sale is held, any teammates or paid participants in Growing Kids, or the insurer of Growing Kids.
- Seller agrees that on the last date of the sale, all unsold items will be sold for half of the price originally designated by the seller unless a "No Disc" visibly appears and is encoded into the barcode beside the price.
- Seller understands that it is their responsibility to fill out each item's tag completely and properly. Seller agrees that any item found WITHOUT A BARCODE on the tag will be sold at Growing Kid's discretion, and that consignors cannot expect to receive credit for items found without a barcode.
- Seller agrees that any items found WITHOUT AN INDEX CARD TAG during the sale will be placed in Lost and Found. Sellers may look through these items at pick-ups for identification. Any items not identified during that time will be donated after the pick-up period is over.
- Seller agrees that ITEMS WITHOUT A RED CIRCLED "R" in the top left corner of the card will automatically be donated if unsold, and will not be available for pick-up.
- Seller agrees that ITEMS NOT PICKED UP by the end of the designated pick-up period will become the property of Growing Kids to be donated to charity or any other sources that could benefit from them. It is the seller's responsibility to get all of their items. We are not responsible for any items missed or forgotten.
- Seller agrees that no claims will be made against Growing Kids Consignment Sale LLC for any discrepancies involving items placed in the sale.
- Seller agrees to cash issued proceed checks within 90 days of the date of the check, and understands that outstanding checks older than 90 days will be cancelled by Growing Kids.
- Seller agrees to not bring any items that have been recalled. Links to recall lists can be found under the "Product Safety & Recalls" menu option on our website.
- Seller agrees not to bring any items, including Cribs, Pack-n-Plays, Playpens, Car Seats, Bath Seats, Toys, Baby Walkers, Baby Gates and/or Bunk Beds that do not meet the safety standards listed on our "Product Safety & Recalls" page on the website.
- Seller agrees that the distribution of proceeds from the sale of each item will be as follows:
-A 30% sales commission, plus $10 seller fee, will be deducted from the seller's earnings.
-A 25% sales commission, plus $10 seller fee, will be deducted from the earnings of sellers who participate as a teammate, helping for 8 hours during the event.
